    Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures. Genocide addresses these tensions and tests the limits of the concept in cases ranging from the role of sexual violence during the Holocaust and state-induced mass starvation in Kazakh and Ukrainian history to what the Armenian, Rwandan, and Burundi experiences reveal about the uses and pitfalls of reading history and conducting politics through the lens of genocide. Contributors examine the pressures that great powers have exerted in shaping the concept; the reaction Raphaël Lemkin, originator of the word "genocide," had to the United Nations’ final resolution on the subject; France’s long-held choice not to use the concept of genocide in its courtrooms; the role of transformative social projects and use of genocide memory in politics; and the relation of genocide to mass violence targeting specific groups.     Abstract: Mehr als 450 Musiker und Musikerinnen waren unter den etwa 18.000 überwiegend jüdischen Flüchtlingen aus Deutschland und Österreich, die ab 1938 vor der NS-Verfolgung in die chinesische Hafenstadt Shanghai flohen. Für die meisten war die Stadt kein Wunschziel, die zunächst teilweise, später ganz von den Japanern besetzt war. Kriegsbedingt gab es dort aber gerade keine Einreiseformalitäten. Für die Zeit bis zur Machtübernahme der Kommunisten 1949 war das Shanghaier Exil in politischer, kultureller und sozioökonomischer Hinsicht ein Ausnahmefall. In der 3,5 Millionen-Stadt lebten überwiegend Chinesen, daneben existierten aber exterritoriale Niederlassungen von Franzosen, Briten und US-Amerikanern. Außerdem gab es zahlreiche weitere Ausländergruppen, darunter russische Revolutionsflüchtlinge, Auslandsdeutsche und die Mitglieder bagdadisch-sephardischer und russisch-aschkenasischer jüdischer Gemeinden. Die Flüchtlinge hatten dabei zeitweilig mit einer verordneten Ghettoisierung, Kriegseinwirkungen, Inflation und Mangelversorgung zu kämpfen.

    Abstract: Nachdem er jahrelang die Zerstörung seiner Familie im Holocaust verdrängte, beginnt der Geigenbauer Amnon Weinstein in seiner Werkstatt in Tel Aviv in den 1990er Jahren damit, Geigen zu restaurieren, die von jüdischen Musikern während des Holocausts gespielt wurden. Denn vor ihm steht ein Mann, der im Orchester von Auschwitz spielte, seine Violine über Jahrzehnte nicht angerührt hat und sie nun für seinen Enkel reparieren lassen will. Als Weinstein das Instrument öffnet, entdeckt er im Inneren Asche, die aus den Krematorien stammen muss. Grymes erzählt die Geschichte von sieben Geigen, die Weinstein in den folgenden Jahren zu neuem Glanz und Leben erweckt: Für die Musiker konnten sie ein Mittel sein, um rechtzeitig aus Europa zu fliehen, wie bei Bronislaw Hubermann, dem Gründer des Palestine Orchestra, des späteren berühmten Israel Philharmonic Orchestra. Um nicht vollständig Mut und Verstand zu verlieren, wenn sie wie Erich Weininger bei seiner Odyssee nach Palästina von den Briten abgefangen und für Jahre nach Mauritius deportiert wurden. Oder wie Henry Meyer in Konzentrationslagern und Ghettos um ihr Leben spielten. Geigen konnten sogar dazu dienen, sich mit Waffen zu wehren, wie die Geschichte von Mordechai Schlein zeigt, der es schaffte, mit Hilfe eines Geigenkastens, in dem er Sprengstoff versteckte, einen Club voller SS-Offiziere in die Luft zu jagen. Und sie wurden zum einzigen Andenken an lang vermisste Verwandte, wie bei Shimon Krongeld, dessen Instrument nach seinem Tod völlig unerwartet bei seiner Familie in Jerusalem auftauchte.

    Abstract: The book provides in depth studies of two epistemological aspects of Jewish Law (Halakhah) as the?Word of God?? the question of legal reasoning and the problem of knowing and remembering. - How different are the epistemological concerns of religious-law in comparison to other legal systems? - In what ways are jurisprudential attitudes prescribed and dependent on theological presumptions? - What specifies legal reasoning and legal knowledge in a religious framework? The author outlines the rabbinic jurisprudential thought rooted in Talmudic literature which underwent systemization and enhancement by the Babylonian Geonim and the Andalusian Rabbis up until the twelfth century. The book develops a synoptic view on the growth of rabbinic legal thought against the background of Christian theological motifs on the one hand, and Karaite and Islamic systemized jurisprudence on the other hand. It advances a perspective of legal-theology that combines analysis of jurisprudential reflections and theological views within a broad historical and intellectual framework. The book advocates two approaches to the study of the legal history of the Halakhah: comparative jurisprudence and legal-theology, based on the understanding that jurisprudence and theology are indispensable and inseparable pillars of legal praxis

    Abstract: Sous l’Occupation, Paris ne reste pas silencieux. Peu après l’installation des Allemands, les musiciens reprennent leurs activités comme l’ensemble des artistes. Les salles de concerts et les studios radiophoniques et d’enregistrement se remettent à fonctionner. Dans ce contexte, nombre d’interprètes et de compositeurs français bénéficient de conditions de travail inédites, profitant de l’absence de concurrence étrangère conjuguée à la mise à l’écart des œuvres des compositeurs, morts ou vivants, exclus par les lois scélérates. Centré sur la musique savante, cet ouvrage collectif traite de la diffusion de la musique, grâce à des études sur quelques sociétés de concerts spécifiques à cette période, sur des œuvres du répertoire, sur la création contemporaine et sur le rôle de certains interprètes. Il met en évidence les personnalités de Francis Poulenc, Olivier Messiaen et Arthur Honegger ainsi que d’Alfred Cortot, Germaine Lubin, Charles Munch et Wilhelm Kempff, en insistant sur les ambiguïtés entretenues rétroactivement par certains acteurs de la vie musicale sur leur carrière pendant les années noires. Il analyse également la manière dont quelques grandes figures du passé (Mozart, Berlioz, Wagner) sont susceptibles de s’inscrire dans un discours de propagande, largement véhiculé par les critiques et les musicologues. Cette réflexion sur la trace mémorielle d’une époque se clôt par l’évocation de deux débats récents, qui montrent que ce passé passe difficilement.

    Abstract: Unmittelbar nach der Machtübernahme begannen die Nationalsozialisten ihr Programm zu verwirklichen, die Juden aus dem politischen, kulturellen und wirtschaftlichen Leben "auszuschalten". Den Auftakt bildete die Verdrängung der jüdischen Juristen aus ihren Berufen. Wie dieser Prozess in Hamburg verlaufen ist, beschreibt Heiko Morisse in seiner zweibändigen Untersuchung.Band 1, eine aktualisierte und erweiterte Neuauflage seines 2003 erschienenen Buchs "Jüdische Rechtsanwälte in Hamburg", behandelt die Ausgrenzung und Verfolgung der Hamburger jüdischen Rechtsanwälte, Band 2 die berufliche Verdrängung der beamteten Juristen in Hamburg, insbesondere der Richter, Staatsanwälte und Verwaltungsjuristen. Um die Auswirkungen der nationalsozialistischen Ausgrenzungspolitik auf die Betroffenen erfahrbar werden zu lassen, werden neben den konkreten Umständen der beruflichen "Ausschaltung" auch die weiteren Verfolgungsetappen von der Vertreibung über Deportation bis hin zur Ermordung beschrieben.     Abstract: "Im Zentrum der Untersuchung steht das Gerichtsverfahren gegen Wilhelm Harster vor dem Münchener Landgericht wegen Beihilfe zum Mord in 82.854 Fällen. Als Befehlshaber der Sicherheitspolizei in Den Haag war er an maßgeblicher Stelle mitverantwortlich für die Deportation eines Großteils der niederländischen Juden. Mitangek-lagt waren Wilhelm Zoepf, der Harster ehemals direkt unterstellte Leiter des Haager "Judenreferates", sowie die dort angestellte Gertrud Slottke. Die Darstellung setzt zunächst die Biographien der Beschuldigten in den Zusammenhang von Generation und Weltanschauung und verortet dann ihre jeweiligen Verantwortung für die Deportationen in der Struktur der deutschen Verwaltung in den besetzten Niederlanden. Dabei wird die zeitgenössische Forschungsperspektive der 1960er Jahre auch mit dem aktuellen geschichtswissenschaftlichen Erkenntnishorizont abgeglichen. Resümierend stellt der Autor dieses erste Verfahren gegen einen sogenannten Schreibtischtäter in den Kontext der "Bewältigungsgeschichte" der jungen Bundesrepublik Deutschland."

    Abstract: Main description: Der Staatssekretär im Reichsministerium des Innern Wilhelm Stuckart (1902-1953) war einer der wichtigsten juristischen Interpreten und Legitimatoren des NS-Staates. Als Mit-Autor der Nürnberger Rassegesetze goss er dessen biologistische Grundlagen in Gesetze und begleitete später die Vorbereitungen zum Genozid. Im Frühjahr 1942 vertrat er auf der Endlösungskonferenz am Wannsee sein Ressort. Nach dem Krieg gehörte Stuckart zu den Schöpfern der Legende von der "sauberen Verwaltung", die sich den rassistischen Ansprüchen der NS-Machthaber widersetzt habe. Die biographische Auseinandersetzung mit Stuckart belegt nicht nur die prägende Funktion von führenden Juristen in der NS-Verwaltung, sie untersucht auch die Rolle der Innenverwaltung und ihre Mitwirkung am Genozid.

    Abstract: Human rights offer a vision of international justice that today's idealistic millions hold dear. Yet the very concept on which the movement is based became familiar only a few decades ago when it profoundly reshaped our hopes for an improved humanity. Here, historian Samuel Moyn elevates that transformation to center stage and asks what it reveals about the ideal's troubled present and uncertain future. It was on the ruins of earlier political utopias, Moyn argues, that human rights achieved contemporary prominence. The morality of individual rights substituted for the soiled political dreams of revolutionary communism and nationalism as international law became an alternative to popular struggle and bloody violence. But as the ideal of human rights enters into rival political agendas, it requires more vigilance and scrutiny than when it became the watchword of our hopes.--From publisher description

    Abstract: Blossoms on the Olive Tree is an American woman's account of work that Israeli and Palestinian women are doing to educate themselves and their societies about militarization, human rights, women's rights, and the democratic process. The book highlights women on both sides of the political divide who reach out to each other, engage in bi-national dialogue, and challenge ongoing violence. Despite severe societal restraints in carving out political space for themselves, women in both societies have devised creative opportunities. Powers documents the women's working committees attached to Palestinian political parties and the creativity of Israeli women striving to "civil-ize" their society. Ironically, it is their marginalization that offers women space to engage in their peace-building efforts. The book ends with a clarion call for the implementation of UN Resolution 1325, which requires the presences of women at the highest levels of peace negotiations. Women, with their commitment to reconciliation and healing, bring a significant vision to the enterprise of peace-building, and Powers suggests that it's high time they be taken seriously
    Abstract: In the course of researching this book, Powers stayed in Jewish homes, Muslim homes, and Christian homes, observing women going about their daily tasks. She shared Shabbat dinners and Christmas dinners, Muslim family celebrations, herbal tea and Arab coffee, benefiting from extraordinary hospitality, and learning that Israeli and Palestinian are more alike than they are different. Like women everywhere, Jewish and Arab women care deeply for their children, put up with anger and abuse from their husbands, and try to negotiate a path between societal expectations and personal convictions. Virtually all of them yearn to live in peace, to raise their families without fear, and to enjoy the small pleasures of life without anxiety for the future. These are their stories, and they impart a measure of humanity to the occupation, the Separation Wall, and living with the fear of suicide bombings that is difficult to glean from nightly news reports. Most important, these remarkable women are succeeding in changing from within the way in which their own societies think about themselves
