Abstract:
The post-1945 period gave way to a new historical era requiring intense reflection on the notions of democracy, democratisation of the law and the state of law. Fritz Bauer, a German-Jewish magistrate, is the very example of this reflection that contributed to the reconstruction of democracy. He chose to return to Germany at the end of the Second World War, and therefore to remain in the diaspora, and took an active part in the reconstruction of post-Hitler Germany, despite the continued existence of an elite corrupted by Nazism. Fritz Bauer eventually regained a measure of optimism, not from his fellow lawyers, but by relying on Jewish history and philosophy to defend democratic values. The article therefore paints a portrait of this tireless democrat who devoted his life to the pursuit of law and justice.
