Abstract:
The gray space of colonization in the occupied Palestinian territories is explored in this article in terms of legal geography. The investigation aims to analyze the links between colonization, ethno-national ambitions for territorial control, law, and legitimacy by focusing on three technologies of territorial control: state of emergency, patching processes, and informal planning. The most recent technology, at the heart of the article, is implemented in the establishment and legalization of outposts. Thus, the outposts are described as a colonial practice located on the continuum of “formal” colonies in the occupied Palestinian territories that seek legitimacy. The quest for legitimacy obligates politicians and the state bureaucracy to compromise with the legal authorities, mainly through minimal protection of the property rights of Palestinian landowners. The dialogue with the legal authorities, the evacuation of outposts, the challenge of international condemnation, and the political demands are described in the article as encoding the spatial facades of law in different shades of gray. This encoding undermines the dichotomies between legality and illegality, and by exposing it, offers a new toolbox for analyzing the relations between law and space.
