Abstract:
Discusses the politicization of jurisprudence in Nazi Germany with its rejection of 19th-century positivism. The main elements of the Nazi judicial system were pragmatism, effective morality, and the importance of "concrete" and community spirit as opposed to dualism, abstract thought, and liberal individualism. These were considered "Jewish" rather than German values. Quotes from Carl Schmitt, Karl Larenz, and other Nazi jurists showing how, in Nazi doctrine, race, morality, and law were gradually seen as identical and so became a tool of Hitler's power.
