Starting with Philip Roth as a catalyst, David Hadar reveals a larger network of authors involved in formations of Jewish American literary identity, including among others Cynthia Ozick, Saul Bellow, Nicole Krauss, and Nathan Englander. Whether it's incorporating other writers into fictional work as characters, interviewing them, publishing critical essays about them, or invoking them in paratext or publicity, writers use a variety of methods to forge public personas, craft their own identities as artists, and infuse their art with meaningful cultural associations.     Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

    Abstract: "This book is an updated and expanded study of the manner in which the Supreme Court of Israel has related to petitions challenging actions of the Israeli authorities in the territories occupied by Israel during the 1967 War. The first edition of the study was published two decades ago by one of the present authors, David Kretzmer. The original work was completed just before the second intifida began in September 2000. It covered decisions of the Supreme Court both during the formative years of the Court's jurisprudence on the occupation, and during the first intifada that broke out in December 1987. As stated in the preface to the first edition, the beginning of the second intifada proved that the hopes that the historic Oslo Accords between Israel and the PLO (1993-1995) would lead to peace between Israel and the Palestinians and to the end of the occupation were premature. At the present time (2020) an end to direct Israeli control over the West Bank and restrictions on life in Gaza does not seem to be in sight. The so-called peace plan published by the Trump Administration in February 2020, as we were completing the manuscript, does not alter that picture, although it may contribute to changes in the regime in the West Bank. Much that has happened since the first edition was published has affected the type of cases that reach the Supreme Court, and consequently the topics covered in this study. After a wave of suicide bombings in Israel in 2001 and 2002 the IDF embarked on a military operation in the West Bank. This operation and subsequent hostilities between the IDF and armed Palestinian groups yielded a host of petitions relating to means and methods of warfare and to judicial review during active hostilities. In 2002 the Israeli government began the construction of a separation barrier in the West Bank, the declared purpose of which was to make it more difficult for potential Palestinian terrorists to enter Israel itself. The barrier's route not only spurred close to two hundred petitions to the Supreme Court; it was also the subject of an advisory opinion by the International Court of Justice. In August 2005 Israel withdrew its armed forces and civilian settlements from the Gaza Strip under the Disengagement Plan, and the government announced that Israel no longer had responsibility for Gaza. Controversy arose whether Gaza remained occupied territory. In 2006 the Hamas movement gained control over Gaza and the Government of Israel declared Gaza to be 'hostile territory.' The relations between Israel and Gaza have been tense ever since, with firing of rockets and bombs on Israeli towns and villages, severe restrictions on supply of goods to Gaza and movement of people between Gaza and the West Bank, and periods of active hostilities between Israel and Gaza. Since the first edition of this study was completed there has been a dramatic expansion in the number of Israeli settlements and settlers in the West Bank. This expansion has had various legal and practical consequences, including the emergence of two different legal regimes applicable to Israelis and to Palestinians resident in the West Bank"--

Tina Frühauf provides a kaleidoscopic panorama of musical practices in worship and social life across the country to illuminate how music contributed to transitions and transformations within and beyond Jewish communities in the aftermath of the Holocaust. Drawing on newly unearthed sources from archives and private collections, this book covers a wide spectrum of musical activity – from its role in commemorations and community events to synagogue concerts and its presence on the radio – across the divided Germany until the Fall of the Wall in 1989. Frühauf's use of mobility as a conceptual framework reveals the myriad ways in which the reemergence of Jewish music in Germany was shaped by cultural transfer and exchange that often relied on the circulation of musicians, their ideas, and practices within and between communities. By illuminating the centrality of mobility to Jewish experiences and highlighting how postwar Jewish musical practices in Germany were defined by politics that reached across national borders to the United States and Israel, this pioneering study makes a major contribution to our understanding of Jewish life and culture in a transnational context.

    Abstract: A scholar of law and religion uncovers a surprising origin story behind the idea of the separation of powers. The separation of powers is a bedrock of modern constitutionalism, but striking antecedents were developed centuries earlier, by Jewish scholars and rabbis of antiquity. Attending carefully to their seminal works and the historical milieu, David Flatto shows how a foundation of democratic rule was contemplated and justified long before liberal democracy was born. During the formative Second Temple and early rabbinic eras (the fourth century BCE to the third century CE), Jewish thinkers had to confront the nature of legal authority from the standpoint of the disempowered. Jews struggled against the idea that a legal authority stemming from God could reside in the hands of an imperious ruler (even a hypothetical Judaic monarch). Instead scholars and rabbis argued that such authority lay with independent courts and the law itself. Over time, they proposed various permutations of this ideal. Many of these envisioned distinct juridical and political powers, with a supreme law demarcating the respective jurisdictions of each sphere. Flatto explores key Second Temple and rabbinic writings-the Qumran scrolls; the philosophy and history of Philo and Josephus; the Mishnah, Tosefta, Midrash, and Talmud-to uncover these transformative notions of governance. The Crown and the Courts argues that by proclaiming the supremacy of law in the absence of power, postbiblical thinkers emphasized the centrality of law in the people's covenant with God, helping to revitalize Jewish life and establish allegiance to legal order. These scholars proved not only creative but also prescient. Their profound ideas about the autonomy of law reverberate to this day.

One of my best friends in Kiel,the lawyer Spiegel, has been murdered and of course I myself cannot venture to show myself again in the present Germany (...)1 As this example shows, the Nazi revolution upended many of the things considered self-evident in Europe at the time: it appeared that the ideals of humanity, equality, rights and security were abandoned. Compounding the sense of crisis was the notion that truth and falsehood had lost their meanings, becoming dependent on the vagaries of the powers that be. A mere decade and a half after the carnage of the First World War had ended, a new barbarism had risen in Germany, the land that had previously been considered the centre of European civilization. The Nazi repression was a direct attack on the European tradition of justice and the rule of law.     Abstract: Joseph Joachim (1831-1907), of Jewish-Hungarian descent, was arguably the greatest violinist of the nineteenth century. His performing career in Berlin transformed the aesthetics and interpretation of German music. But Joachim was also a composer of virtuoso pieces, violin concertos, orchestral overtures, and chamber music works, all written between 1847 and 1864 in one intense outpouring of creativity. Katharina Uhde follows Joachim's compositional path through a changing cultural milieu. Joachim's compositions display intimate knowledge of the works of Mendelssohn, Wagner, Liszt, Schumann, and Brahms, yet he was no mere imitator. Joachim's style, classically conceived yet seasoned with a preference for dark, melancholy soundscapes and, in the earlier years, ciphers, virtuosity, and 'psychological' programmaticism, emerges as the product of various personal and socio-cultural currents: his search for national, religious, and cultural identity and a mature compositional style. Joachim's music drew on a wealth of treasures accumulated in his process of 'enculturation', which began with Mendelssohn in Leipzig. Joachim's aesthetic evolved from a deeply subjective approach, not insignificantly inspired by his muse, Gisela von Arnim. Her circle - the von Arnim and Grimm families - became Joachim's cultural and literary haven.     Abstract: The Holocaust, Corporations, and the Law explores the challenge posed by the Holocaust to legal and political thought by examining the issues raised by the restitution class action suits brought against Swiss banks and German corporations before American federal courts in the 1990s. Although the suits were settled for unprecedented amounts of money, the defendants did not formally assume any legal responsibility. Thus, the lawsuits were bitterly criticized by lawyers for betraying justice and by historians for distorting history. Leora Bilsky argues class action litigation and settlement offer a mode of accountability well suited to addressing the bureaucratic nature of business involvement in atrocities. Prior to these lawsuits, legal treatment of the Holocaust was dominated by criminal law and its individualistic assumptions, consistently failing to relate to the structural aspects of Nazi crimes. Engaging critically with contemporary debates about corporate responsibility for human rights violations and assumptions about "law," she argues for the need to design processes that make multinational corporations accountable, and examines the implications for transitional justice, the relationship between law and history, and for community and representation in a post-national world. In an era when corporations are ever more powerful and international, Bilsky's arguments will attract attention beyond those interested in the Holocaust and its long shadow

    Abstract: "Texts often occupy a central role within ritual practices. They serve as prescripts for the organization of the ritual or as an explanation of cosmological backgrounds, as records of ritual performance, or simply as items that are handled and recited during the performance itself. Musical texts may assume some of these roles within certain ceremonial procedures, especially in serving as prescripts for recitation, but also as ritual paraphernalia (for example, where collectors aer concerned). Most importantly, they may serve as records of the performance of those rituals in which music forms a central part, as is the case with opera productions. This volume aims to identify the mechanisms according to which texts, and especially musical texts, may become ritual agents in their own right. Calico examines the cultural history of postwar Europe through the lens of the performance and reception of Arnold Schoenberg's A Survivor from Warsaw--a short but powerful work, she argues, capable of irritating every exposed nerve in postwar Europe. A twelve-tone piece in three languages about the Holocaust, it was written for an American audience by a Jewish composer whose oeuvre had been one of the Nazis' prime exemplars of entartete (degenerate) music. This book investigates the meanings attached to the work as it circulated through Europe during the early Cold War in a kind of symbolic musical remigration, focusing on six case studies: West Germany, Austria, Norway, East Germany, Poland, and Czechoslovakia. The evidence, which the author has accrued from numerous interviews and a detailed survey, is nowhere more telling than in areas that demand religious sanction such as marriage, burial, the sale of pork, and the operation of businesses on the Sabbath. This book makes an important and timely contribution to the study of contemporary Israeli society, as new alliances are being forged in the political arena"--

Les salles de concerts et les studios radiophoniques et d’enregistrement se remettent à fonctionner. Dans ce contexte, nombre d’interprètes et de compositeurs français bénéficient de conditions de travail inédites, profitant de l’absence de concurrence étrangère conjuguée à la mise à l’écart des œuvres des compositeurs, morts ou vivants, exclus par les lois scélérates. Centré sur la musique savante, cet ouvrage collectif traite de la diffusion de la musique, grâce à des études sur quelques sociétés de concerts spécifiques à cette période, sur des œuvres du répertoire, sur la création contemporaine et sur le rôle de certains interprètes. Il met en évidence les personnalités de Francis Poulenc, Olivier Messiaen et Arthur Honegger ainsi que d’Alfred Cortot, Germaine Lubin, Charles Munch et Wilhelm Kempff, en insistant sur les ambiguïtés entretenues rétroactivement par certains acteurs de la vie musicale sur leur carrière pendant les années noires. Il analyse également la manière dont quelques grandes figures du passé (Mozart, Berlioz, Wagner) sont susceptibles de s’inscrire dans un discours de propagande, largement véhiculé par les critiques et les musicologues. Cette réflexion sur la trace mémorielle d’une époque se clôt par l’évocation de deux débats récents, qui montrent que ce passé passe difficilement.
