    Abstract: Today, law is no longer homogenous or unquestioned. Different overlapping legal systems constantly interfere with one another, both on an international level, in complex transnational contexts such as the European Union or human rights law, but also in the context of cultural diversity or conflicts between religious norms and civil institutions, between minorities and the power of the state. On the other hand, the neutrality of law is also under growing pressure, be it from different global transnational players, or from within nation states where calls are made to adapt law to the will of "the people." The heated European debate on the "refugee crisis" has made it manifest that law is more necessary than ever and yet fundamentally contested, perhaps even caught in contradictions and self-limitations. At the same time, the current perspective on legal problems allows us to address issues of diversity and the role of Europe in the globalized world more clearly. The articles of this book take these recent developments and debates as a starting point to discuss from the perspective of different disciplines the pressing question of how to live together in the new millennium and how to figure the long history of law before, besides, and after the dominant paradigm of state law

    Abstract: In 1939, a new Yiddish journal was published in Paris under the name "Oyfn sheydveg" (At the Crossroads). The Authors, primarily Eastern European emigrés, embarked on a quest for an intellectually appropriate response to the political events unfolding before their eyes. Many contributors who were active two decades earlier as Diaspora Nationalists in diverse Eastern European Jewish political parties and institutions now explored new avenues. These included Zionism and Territorialism, but also a return to religious tradition and even to a pre-modern "ghetto life." Unlike hardly any other literary document, "Oyfn sheydveg" sheds light on the profound crisis of these Jewish intellectuals and on the conclusions they drew in the face of the looming catastrophe

    Abstract: What are the future perspectives for Jews and Jewish networks in contemporary Europe? Is there a new quality of relations between Jews and non-Jews, despite or precisely because of the Holocaust trauma? How is the memory of the extermination of 6 million European Jews reflected in memorial events and literature, film, drama, and visual arts media? To what degree do European Jews feel as integrated people, as Europeans per see, and as safe citizens? An interdisciplinary team of historians, cultural anthropologists, sociologists, and literary theorists answers these questions for Poland, Hungary, the Czech Republic, Slovakia, and Germany. They show that the Holocaust has become an enduring topic in public among Jews and non-Jews. However, Jews in Europe work self-confidently on their future on the "old continent," new alliances, and in cooperation with a broad network of civil forces. Non-Jewish interest in Jewish history and the present has significantly increased over decades, and networks combatting anti-Semitism have strengthened

    Abstract: "Jewish texts and traditions. An expression of this was the remarkable turn to Bible translation. In the century and a half between Moses Mendelssohn's pioneering translation and the final one by Martin Buber and Franz Rosenzweig, German Jews produced sixteen different translations of at least the Pentateuch. Buber and Rosenzweig famously critiqued bourgeois German Judaism as a craven attempt to establish social respectability to facilitate Jews' entry into the middle class through a vapid, domesticated account of Judaism. Exploring Bible translations by Moses Mendelssohn, Leopold Zunz, and Samson Raphael Hirsch, I argue that each sought to ground a "reformation" of Judaism along bourgeois lines, which involved aligning Judaism with a Protestant concept of religion. They did so because they saw in bourgeois values the best means to serve God and the authentic actualization of Jewish tradition. Through their learned, creative Bible translations, Mendelssohn, Zunz, and Hirsch presented distinct visions of middle-class Judaism that affirmed Jewish nationhood while lighting the path to a purposeful, emotionally rich, spiritual life grounded in ethical responsibility"--

    Abstract: Ernst Papanek was an Austrian pedagogue who worked with Jewish refugee children in France in 1939/40, before he was forced to leave to the United States. There, he nevertheless continued his work to point out the impact of war, genocide and displacement on children, who were often forgotten in major discussions about the war and the losses it had created. This volume provides a short biographical outline of Papanek and a theoretical discussion about the impact of war and genocide on children who are forced out of their lives and who were not only physically displaced as a consequence.     Abstract: "The Sephardim in the Holocaust: A Forgotten People embraces the Sephardim of all the countries shattered by the Holocaust and pays tribute to the memory of the more than 160,000 Sephardim who perished. Isaac Jack Lévy and Rosemary Lévy Zumwalt draw on a wealth of archival sources, family history (Isaac and his family were expelled from Rhodes in 1938), and more than one hundred fifty interviews conducted with survivors during research trips to Belgium, Canada, France, Greece, Israel, Mexico, the Netherlands, the former Yugoslavia, and the United States. Lévy follows the Sephardim from Athens, Corfu, Cos, Macedonia, Rhodes, Salonika, and the former Yugoslavia to Auschwitz. The authors chronicle the interminable cruelty of the camps, from the initial selections to the grisly work of the Sonderkommandos inside the crematoria, detailing the distinctive challenges the Sephardim faced, with their differences in language, physical appearance, and pronunciation of Hebrew, all of which set them apart from the Ashkenazim. They document courageous Sephardic revolts, especially those by Greek Jews, which involved intricate planning, sequestering of gunpowder, and complex coordination and communication between Ashkenazi and Sephardic inmates-all done in the strictest of secrecy. And they follow a number of Sephardic survivors who took refuge in Albania with the benevolent assistance of Muslims and Christians who opened their doors to give sanctuary, and traces the fate of the approximately 430,000 Jews from Morocco, Algiers, Tunisia, and Libya from 1939 through the end of the war. The author's intention is to include the Sephardim in the shared tragedy with the Ashkenazim and others.     Abstract: "This book is the first to link the modern appreciation for democratic freedom directly to Jewish political thought in seventeenth-century Amsterdam. The modern appreciation for democratic values is often assumed to have its roots in Classical thought. However, democracy has taken various forms in its progression to the governance many countries now employ. Working in dialog with Protestants, Jewish thinkers voiced the first Modern appeal for the reestablishment of a Jewish polity in the Holy Land. This appeal was grounded in a vision of a Jewish state governed by individual liberty and popular consent, which could be defined as a democratic Zionism. The book focuses on influential rabbi Saul Levi Morteira, as well as two of the most renowned members of his congregation, Baruch Spinoza and Miguel de Barrios. Unlike contemporary Catholic and Protestant thinkers, these three intellectuals found democratic values in an Old Testament polity that came to be revered as the Hebrew Republic. The book explores the trajectory by which this democratization of the Hebrew Republic evolved in the writings of Morteira as an alternative to divine-right rule. It then shows that, in spite of their divergent views toward practicing Judaism, Spinoza and Barrios disseminated Morteira's democratic ideas and promoted the Hebrew Republic as a model polity for a post-medieval political order.     Abstract: In December 1945, a Polish-born commuter on a Tel Aviv bus recognized a fellow rider as the former head of a town council the Nazis had established to manage the Jews. When he denounced the man as a collaborator, the rider leapt off the bus, pursued by passengers intent on beating him to death. Five years later, to address ongoing tensions within Holocaust survivor communities, the state of Israel instituted the criminal prosecution of Jews who had served as ghetto administrators or as kapos in concentration camps. Dan Porat brings to light more than three dozen little-known trials, held over the following two decades, of survivors charged with Nazi collaboration. Scouring police investigation files and trial records, he found accounts of Jewish policemen and camp functionaries who harassed, beat, robbed, and even murdered their brethren. But as the trials exposed the tragic experiences of the kapos, over time the courts and the public shifted from seeing them as evil collaborators to victims themselves, and the fervor to prosecute them abated. Porat shows how these trials changed Israel's understanding of the Holocaust and explores how the suppression of the trial records--long classified by the state and to this day withheld by Yad Vashem--affected history and memory. Sensitive to the devastating options confronting those who chose to collaborate, yet rigorous in its analysis, Bitter Reckoning invites us to rethink our ideas of collaboration and justice and to consider what it means to be a victim in extraordinary circumstances.--

    Abstract: "We treat the word Judaism as a given for describing the religion of Jews. But the term is in some ways socially constructed, rather than inevitable. After all, exactly what would constitute "authentic" Judaism? Some have argued that there are multiple Judaisms, going in the direction of plurals that so many scholars find satisfying. But Boyarin takes a different tack, proposing that before the modern era there should be no "Judiasm" at all. For Boyarin, there was no sphere of life that can be called Judaism that was separate from the political, artistic, and cultural elements of life. While the challenges to tracking Jewish conceptions of time during the Holocaust were substantial, Alan Rosen reveals that many took great risks to mark time within that vast upheaval. Rosen inventories and organizes Jewish calendars according to the wartime settings in which they were produced--from Jewish communities to ghettos and concentration camps. The calendars he considers reorient views of Jewish circumstances during the war and show how Jews were committed to fashioning traditional guides to daily life, even in the most extreme conditions. In a separate chapter, moreover, he elucidates how Holocaust-era diaries sometimes served as surrogate Jewish calendars.     Abstract: "Rabbi Menahem Mendel of Kotsk (1787-1859) was one of the most interesting and challenging figures of Hasidism in the nineteenth century. His search for truth and battles against falsehood and spiritual compromise are the subject of many legends, hagiographical stories, and anecdotes. Though he was irascible and demanding, he inspired the loyalty of disciples who went on to become the dominant leaders of Hasidism in Poland from the middle of the nineteenth century to the destruction of Polish Jewry in the Holocaust. R. Menahem Mendel left no surviving writings. His descendants and disciples moved away from the radicalism of his teachings and adopted more conventional and conservative theological positions. As a result, there was little incentive to preserve and publish his teachings. The goal of this work is twofold. First, to present a biographical study of what is known about R. Menahem Mendel that is based on historical research, instead of repeating myths, legends, and stories without regard to their historical veracity. Secondly, to collect, translate, and analyze those teachings and sayings by or about R.     Abstract: "Anti-Semitism and the Holocaust surveys the history of the Holocaust whilst demonstrating the pivotal importance of the historical tradition of anti-Semitism and the power of discriminatory language in relation to the Nazi-led persecution of the Jews. The book examines varieties of anti-Semitism that have existed throughout history, from religious anti-Semitism in the ancient Roman Empire to the racial anti-Semitism of political anti-Semites in Germany and Austria in the late 19th century. Beth A. Griech-Polelle analyzes the tropes, imagery, legends, myths and stereotypes about Jews that have surfaced at these various points in time. Anti-Semitism and the Holocaust considers how this language helped to engender an innate distrust, dislike and even hatred of the Jews in 20th-century Europe. She explores the shattering impact of the First World War and the rise of Weimar Germany, Hitler's rhetoric and the first phase of Nazi anti-Semitism before illustrating how ghettos, SS Einsatzgruppen killing squads, death camps and death marches were used to drive this anti-Semitic feeling towards genocide.     Abstract: "This book reexamines one of the most intense controversies of the Holocaust: the role of Rezső Kasztner in facilitating the murder of most of Nazi-occupied Hungary's Jews in 1944. Because he was acting head of the Jewish rescue operation in Hungary, some have hailed him as a savior. Others have charged that he collaborated with the Nazis in the deportations to Auschwitz. What is indisputable is that Adolf Eichmann agreed to spare a special group of 1,684 Jews, who included some of Kasztner's relatives and friends, while nearly 500,000 Hungarian Jews were sent to their deaths. Why were so many lives lost? After World War II, many Holocaust survivors condemned Kasztner for complicity in the deportation of Hungarian Jews. It was alleged that, as a condition of saving a small number of Jewish leaders and select others, he deceived ordinary Jews into boarding the trains to Auschwitz. The ultimate question is whether Kastztner was a Nazi collaborator, as branded by Ben Hecht in his 1961 book Perfidy, or a hero, as Anna Porter argued in her 2009 book Kasztner's Train. Opinion remains divided. Paul Bogdanor makes an original, compelling case that Kasztner helped the Nazis keep order in Hungary's ghettos before the Jews were sent to Auschwitz, and sent Nazi disinformation to his Jewish contacts in the free world. Analyzing the treatment of the Shoah by five leading figures in Argentine, Brazilian, and Chilean writing—Alberto Gerchunoff, Clarice Lispector, Jorge Luis Borges, Gabriela Mistral, and Joao Guimaraes Rosa—Aizenberg illuminates how Latin American intellectuals engaged with the horrific information that reached them regarding the Holocaust, including the sympathy and collaboration of their own governments with the Nazis. Aizenberg emphasizes how—through fiction, journalism, and activism—these five culture-makers opposed and fought fascism. At the same time, her readings of individual texts confront shopworn clichés about Latin American writing and literature, suggesting deeper and richer dimensions to many canonical works. Dwor argues that midrash, a classical rabbinic interpretive form, is a site of Jewish feeling and that literary works underpinned by midrashic concepts engage affect in a distinctly Jewish way. The book thus emphasises the theological function of literature and also the new opportunities afforded by nineteenth-century literary forms for Jewish women's theological expression. For authors such as Grace Aguilar (1816-1847) and Amy Levy (1861-1889), feeling is a complex and overlapping category that facilitates the transmission of Jewish ways of thinking into English literary forms. Dwor reads them alongside George Eliot, herself deeply engaged with issues of contemporary Jewish identity. This sheds new light on Eliot by positioning her works in a nexus of Jewish forms and concerns. Historical understandings of the Holocaust are defined in terms of the spatial and temporal scales with which the event is portrayed, the protagonists involved, interpretative patterns (according to definitions, comprehensiveness, causes, relativization or banalization), narrative techniques and viewpoints, didactic methods, and national idiosyncrasies. The study is based on 272 currently valid curricula from 135 countries, and on 89 textbooks published in 26 countries since 2000. The aim of the study is primarily to document information in such a way that it reflects local understandings of the Holocaust, principally by recording concepts and narratives of the Holocaust found in educational media currently in use in schools. The findings show both convergence and divergence in the representations analysed. The Holocaust is subject to shared patterns of representation, which include selectivity, personalization, appropriation, screening and omission. It is also subject to narrative idiosyncrasies. One of the main trends worldwide is domestication, a process whereby countries place emphasis on the local significance of the event or appropriate them in the interests of local populations. Drawing on such national and international patterns of representation, the publication concludes by formulating recommendations for future curricula and textbook narratives about the Holocaust. These recommendations relate to such issues as the use of terms, the comprehensiveness of historical facts, the definition of causes, the combination of universal and local approaches, and the development of historical literacy.

    Abstract: "This book proposes to understand the Holocaust by looking at Nazi and German culture and sensibilities that made the persecution and extermination imaginable, possible, and conceivable. It critically reviews the keycurrents in Holocaust historiography in the last generation, arguing for a new approach that places at the center not simply what happened during the Nazi years--the anti-Semetic ideological campaign, the machinery of killing, the brutal massacres during the way--but especially what the Nazi and other Germans thought was happening; a necessary, deathly war against the key enemy, the Jews"--
