Abstract:
This essay was presented as the American Bicentennial Address at the 76th annual convention of the Rabbinical Assembly of America in 1976. The author, an American lawyer and jurist as well as a Jewish scholar, contends that just as the Jewish Written Law (Torah) was explicated in the Jewish Oral Law throughout centuries, American constitutional law has been explicated through significant judicial decisions made during the past 200 years.
