Abstract:
Whereas Judaism was regarded as "religio licita" in the pagan Roman Empire, the Jews' status gradually deteriorated under Christianity (e.g. in the Codex Theodosianus, 438). Contends that the Jews' legal status worsened under the reign of the Emperor Justinian I (527-565), creating an opening for the later persecution of Jews. Laws promulgated in the Codex Iustinianus and in his Novellae, as well as the removal of Judaism as "religio licita, " not only placed restrictions on the Jews but also legally and theologically justified their persecution for not converting to Christianity.
